Technically, the venue should be registered and paying fees with the various licensing agencies, such as ASCAP. Otherwise, they technically shouldn't be playing live music. Heck, I think they even need it if they have a jukebox.

Now, if you are recording covers of other peoples' music (alive or dead) for a CD or even download, you need to pay appropriate licensing fees yourself.
