Re: [Harp-L] misty
Ben-
Of course I would never encouraging you to take any legal risks, but.....
1. No one is likely to come to France to sue you. It would cost them perhaps $50K to do so. And for what? Suing for infringement is very expensive. My publisher and I ruled it out after some psychopath plagiarized my work in a blues magazine a couple years back and Pat Missin brought it to my attention. It would have cost, my publisher told me, 20K to do it within US borders. We just gave her and the magazine grief and threats of legal action until they took the stolen goods off their website.
2. No one can sue you unless they can prove damages. Where are the damages to the copyright holder, especially if there is no congenital score or lyrics, and you are not profiting from this? They have to show that their sales have gone down. The record industry could prove that Napster was costing it something like 10% of their profits, and so they won that case. Your little old tab won't, in all likelihood, hurt anyone's purse.
But, please, don't take any chances.
Heh, heh.

Glenn,
What you suggest would definetely be more legible. I'm slightly worried, however, that I'm already flirting with copyright law. I wouldn't want it to look like I'm doing so even more by including rhythm and end up with a cease and desist...

I have just posted the tab to Jerry Portnoy's Misty from his album Homerun
Hitter on my blog at http://harmonica.typepad.com. I hope it's useful to
some of you!

Ben-
Is there any way to include bar lines and rhythm stems (1/4 note, 1/8 note,
ties, etc) in this tab with the software that was used to create it?
A system of rhythm-stemmed tab for harmonica, even without the conventional
staff and noteheads, would be an amenity if it could be done. To see what I
mean, look at Guitar World magazine, which has this kind of stemmed tab.
